New York Asbestos Lawsuits
Asbestos fibers are deadly and can cause severe medical conditions such as mesothelioma. A New York asbestos lawyer is experienced in handling asbestos lawsuits which seek financial compensation for victims and their families for exposure to this toxic substance. These cases can be complex, so it’s important to have a mesothelioma lawyer on your side.
New York has a long history of asbestos litigation and many residents have been exposed to the dangerous material. In recent years, there have been more lawsuits against asbestos producers in the past than ever before. These cases stem from the recognition of a link between asbestos and certain diseases such as mesothelioma, lung cancer and asbestosis. These companies were aware of asbestos’ dangers, but failed to warn employees and consumers.
New York City is especially susceptible to illnesses caused by asbestos because of its older structures and construction sites. Brooklyn Navy Yard is a notoriously hazardous area that continues to impact the surrounding community.
Many workers were exposed asbestos at work. However, some people are diagnosed with mesothelioma after experiencing secondhand exposure to the harmful substances. This includes spouses who wear husband’s clothing to work and come into contact with asbestos dust on a regular basis.
The mesothelioma lawsuit can be costly for defendants, particularly if they are wrongfully named as defendants. According to an investigation, more than 3,600 claims have been filed in New York courts since 2014, and the number could increase further. This kind of litigation is usually supported by asbestos law firms that advertise on daytime television and encourage victims to file claims with the promise of huge settlements.
The defendants might be able to reduce the cost of these cases by arguing that their policy periods are overdue or that they are only responsible for only for a small proportion of the amount claimed. However, New York law has not established a clear rule regarding how to allocate liabilities when the alleged exposure occurs within and outside the insurance company’s policy.
Asbestos-Related Diseases
Exposure to asbestos can cause many different illnesses. The most severe condition is mesothelioma. Many have died from mesothelioma. Other asbestos-related diseases include lung cancer asbestosis, pleural plaques, and the pleural effusion.
Mesothelioma is a rare, but fatal illness caused by exposure to asbestos fibers that collect in the lungs, and can cause irritation to the lining of the chest cavity, ribcage, and abdominal cavity (the the pleura). Inhaling these tiny fibers can cause scarring to the lungs known as asbestosis and, sometimes, the formation of thickened patches on the pleura referred to as pleural plaques or a more widespread fibrosis of the pleura known as diffused fibrisis. Pleural plaques and diffused fibrisis reduce lung capacity, as measured by breathing tests. They can also cause pain and difficulty in breathing, but they don’t cause cancer or mesothelioma.
Most of the time, symptoms of asbestos-related diseases don’t manifest until decades after initial exposure. It can take up to 50 years for asbestos-related fibers to be inhaled to cause lung damage. Workers who handled, cleaned and removed asbestos from the workplace as well as children, spouses and other people who are exposed to asbestos are at risk for developing mesothelioma.
In addition to mesothelioma lawyers, other asbestos-related diseases include lung cancer, laryngeal cancer, peritoneal mesothelioma, and mesothelioma lawsuits of the ovary. Ovarian cancer is among the most deadly form of mesothelioma for women, but it is less prevalent than mesothelioma in general. It is often diagnosed later than other forms of mesothelioma because it develops in the tissues of the reproductive organs and the symptoms can be similar to those of other illnesses.
Many companies employed asbestos in the 20th century, but they knew that it was a risk. When they failed to remove asbestos from their products thousands of people were exposed. They can now seek financial compensation. Many asbestos-related companies are bankrupt. The victims can now seek compensation from trust funds created by bankruptcy courts.
